Service Availability

Our website is only intended for use by UK residents (mainland only), and we reserve the right to not accept orders from individual residents elsewhere.

Your Status

Placing an order through our website, you warrant that:

  • You are legally capable of entering into a binding contract.
  • You are at least 18 years old.
  • You are a resident in the United Kingdom (mainland only).

Contract Formation

After placing an order, you will receive an email acknowledging receipt. This does not constitute acceptance of your order. Your order is an offer to purchase from us, subject to our acceptance. We will confirm acceptance by sending an email confirming your order, at which point a binding contract is formed.

The contract will only cover the products confirmed in the acceptance email. We are not obligated to supply any additional products from your order unless confirmed separately.

Any drawings, photographs, descriptions, or illustrations on our site are intended to give a general idea of the products. They do not form part of the contract between you and us.

Consumers Rights

If you are contracting as a consumer, you have the right to cancel a contract within fourteen working days, starting from the day you receive the products. In such cases, you will receive a full refund of the purchase price, in accordance with our refund policy.

To cancel a contract, you must notify us in writing. Additionally, you are required to return the products to us immediately, in the same condition as when you received them, and at your own cost and risk. You have a legal obligation to take reasonable care of the products while they are in your possession. Failure to comply with this obligation may entitle us to seek compensation from you.

Please note that you do not have the right to cancel a contract for the supply of the following products:

  • Goods where a fault has been discovered that could have been identified without unsealing the products.
  • Goods made to your specification, that have been clearly personalised, or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly.

Details of this statutory right, and an explanation of how to exercise it, are provided in the acceptance confirmation. This provision does not affect your statutory rights.

Availability & Delivery

Your order will be fulfilled by the delivery date specified in the acceptance confirmation. If no delivery date is indicated, the order will be delivered within 30 days of the acceptance confirmation, except in exceptional circumstances.

Delivery will be made to the address provided in your order. If you need to change the delivery address after your order has been dispatched, please contact us at 020 8965 9281 or via email at sales@brownell.co.uk.

Orders placed before the specified cut-off time will be processed the same day and delivered in accordance with your delivery request, provided all products are available. Please note that delivery will only occur once clear funds have been received.

Risk & Title

The risk associated with the product will transfer to you upon delivery. If your goods are shipped via Royal Mail, please note that they cannot be tracked. For shipments sent via UPS Next Day Service, you will receive a tracking number that allows you to monitor the delivery status of your goods.

Price & Payment

The prices of all products will be listed on our website.

These prices include VAT but exclude delivery costs, which will be added to the total amount due. Prices are subject to change at any time; however, any changes will not affect orders for which we have already sent an acceptance confirmation.

Although we strive to ensure all prices are accurate, errors may occur. If we discover a pricing error, we will verify the price before dispatching the product. If the correct price is lower than the listed price, we will charge the lower amount. If the correct price is higher, we will, at our discretion, either contact you for instructions before dispatch or reject your order and notify you of the rejection.

We are not obligated to provide the product at an incorrect (lower) price if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as a mispricing, even after we have sent an acceptance confirmation.

Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an acceptance confirmation.

Payment for all products must be made by credit or debit card. We accept Visa, Visa Electron, MasterCard, Maestro, and payments through Opayo, Apple Pay, Google Pay and PayPal. Products will not be dispatched until we receive cleared funds. No payment will be deemed received until the funds have cleared.

Your credit/debit card details will be encrypted to minimize the possibility of unauthorised access or disclosure. Payment authorisation must be provided at the time of order. If there is an issue with processing the payment, we may contact you by telephone or email.

Refunds & Returns

When you return a product to us:

If you cancel the contract within the 14-day cooling-off period, we will process your refund as soon as possible, and no later than 14 days after you notify us of your cancellation, provided the goods are returned in the same condition as delivered. The refund will include the full product price and the cost of standard delivery (excluding any premium delivery surcharges). You are responsible for the cost of returning the item to us. We recommend using a recorded delivery method, as we are not liable for any loss or damage during transit.

If you return a defective product, we will examine it and notify you via email whether you are entitled to a repair, replacement, or refund. We aim to process this as soon as possible, and no later than 30 days after receiving the defective product. If a refund is warranted, it will include the cost of sending the item to you and the cost incurred in returning the defective product to us. There will be no charge for redelivery of repaired or replaced products.

If you choose to return the defective product using your own delivery method, we will refund up to £3.50 of the incurred costs upon receiving proof of carriage costs.

Refunds of any money received from you will be made using the same payment method originally used by you to pay for your purchase and paid back into your account.

All refunds will be processed using the original payment method and credited back to your account.

Our Liability

We warrant that any product purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes for which products of that kind are commonly supplied. This warranty does not apply to any defects arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, misuse of the product, failure to follow instructions, or any alterations or repairs you carry out without our prior written approval.

Our liability for any losses you suffer as a result of us breaching this agreement is strictly limited to the purchase price of the product you purchased.

This limitation does not include or limit in any way our liability for:

  • Death or personal injury caused by our negligence.
  • Liability under section 2(3) of the Consumer Protection Act 1987.
  • Fraud or fraudulent misrepresentation.
  • Any deliberate breaches of these terms by us that would entitle you to terminate the contract.
  • Any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

We are not responsible for any indirect or consequential losses which occur as a side effect of the main loss or damage, even if such losses result from a deliberate breach of this contract by us that would entitle you to terminate the contract, including but not limited to:

  • Loss of income or revenue
  • Loss of business
  • Loss of profits or contracts
  • Loss of anticipated savings
  • Loss of data

This warranty is provided in accordance with UK laws and regulations, ensuring your statutory rights are not affected.

Data Protection

Except as expressly set out in these terms and conditions, all use of your personal information will be made in accordance with our privacy policy.

By registering any of the personal details with us, you are agreeing to allow us to contact you regarding any of our own products or services, we may pass your details to a third-party unless otherwise indicated to by you.

Security

To ensure that your credit card, debit or charge card is not being used without your consent, we will validate name, address and other personal; information supplied by you during the order process against appropriate third-party databases.

By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered credit reference agency, which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.

During security checks we may ask for additional information or documentation to help support the data you have supplied.

Written Communications

Under applicable UK laws, certain information and communications we send to you must be in writing. By using our website, you agree that our primary mode of communication will be electronic. We will contact you via email or provide information through notices posted on our website. For contractual purposes, you consent to receive communications from us electronically and acknowledge that all contracts, notices, information, and other communications we provide to you electronically fulfil any legal requirement for written communication. This condition does not affect your statutory rights.

Notices

All notices from you to us must be addressed to Brownell Limited, Unit 2, Abbey Road Industrial Park, Commercial Way, Park Royal, London, NW10 7XF. We may send notices to you via the email or postal address you provided when placing an order. Notices will be deemed received and properly served immediately upon being posted on our website, 24 hours after an email is sent, or three days after a letter is posted. To ensure proper service of any notice, it is sufficient to prove that, in the case of a letter, it was correctly addressed, stamped, and placed in the post, and in the case of an email, that it was sent to the specified email address of the recipient.

Transfer of Rights & Obligations

The contract between you and us is binding on both parties, as well as our respective successors and assigns.

You may not transfer, assign, charge, or otherwise dispose of a contract, or any of your rights or obligations under it, without our prior written consent.

We reserve the right to transfer, assign, charge, sub-contract, or otherwise dispose of a contract, or any of our rights or obligations under it, at any time during the term of the contract.

Events Outside of Our Control

We will not be liable or responsible for any failure to perform, or delay in performing, our contractual obligations due to events outside our reasonable control (Force Majeure Event).

A force Majeure Event includes any act, event, non- occurrence, omission or accident beyond our reasonable control and includes (without limitation) the following:

  • Strikes, lockouts, or other industrial actions
  • Civil commotion, riots, invasions, terrorist attacks or threats, war (declared or undeclared), or threats or preparations for war
  • Fire, explosions, storms, floods, earthquakes, subsidence, epidemics, or other natural disasters
  • Impossibility of using railways, shipping, aircraft, motor transport, or other means of public or private transport
  • Impossibility of using public or private telecommunications networks
  • Acts, decrees, legislation, or restrictions imposed by any government

Our performance under any contract is deemed to be suspended for the period that the Force majeure event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure event to a close or to find a solution by which our obligations under the contract may be performed despite the force majeure event.

Waiver

If we fail, at any time during the term of a contract, to insist upon strict performance of any of your obligations under the contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitles under the contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.

A waiver by us of any default shall not constitute a waiver of any subsequent default.

No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with clause 14 above.

Severability

If any of these terms and conditions or any provisions of a contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be served from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

Entire Agreement

We intend to rely on these terms and conditions, along with any documents expressly referred to herein, concerning the subject matter of any contract. While we accept responsibility for statements and representations made by our duly authorized agents, please ensure that any variations from these terms and conditions are confirmed in writing.

Our Right to Vary These Terms & Conditions

We reserve the right to revise and amend these terms and conditions periodically to reflect changes in market conditions, technology, payment methods, relevant laws, regulatory requirements, and our system capabilities.

You will be subject to the policies and terms and conditions in effect at the time you order products from us, unless a change to these policies or terms and conditions is required by law or governmental authority (in which case it will apply to previously placed orders) or if we notify you of changes to these policies or terms and conditions before we send you the acceptance confirmation. In such cases, we assume you have accepted the changes unless you notify us otherwise within seven working days of receiving the products.

Law & Jurisdiction

Contracts for the purchase of products through our website and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English Law. Any dispute or claim arising out of or in connection with such contracts or their formation (including non-contractual disputes and claims) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

Order & Returns Policy
Change or cancel an order

If you need to change details of your delivery address, remove items from your order or cancel it completely, please contact our Customer Services team for advice on 020 8965 9281 between 8.00am and 5.00pm (Monday - Thursday), 8.00am - 12:30pm (Friday) or email us here. Please be ready to your order number and order date.

If your order has already been despatched or delivered, then you'll need to follow our cancellation procedure below outlined below.

Consumer Contracts Regulations

Under the Consumer Contracts Regulations 2013, you have the following cancellation rights when you buy online or by phone:

  • You are entitled to cancel your contract within 14 days after the day you receive the goods or services.
  • Your right to return products does not apply to goods made to your specification, that have been clearly personalized, or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly.
  • If you wish to exercise your right of cancellation, you must retain possession of the goods and take reasonable care of them.
  • To exercise your right to cancel, you must inform us of your decision by a clear statement, including details of your name, address, details of the order you wish to cancel, and, where available, your phone number and email address.

If you decide to cancel, you should return the goods to us at your cost within 14 days of such cancellation. We will reimburse you by the method used to pay for the original transaction, including the cost of delivery.

We may make a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of unnecessary handling by you. The reimbursement will be made no later than 14 days after we receive the goods back.

Dispatch & Delivery Times

UPS orders are standard next working day delivery. Orders placed before 12:00pm GMT Monday to Thursday, will be received next working day and orders placed after 12:00pm or on Friday, will be despatched next working day.

Track Your Order

If your goods are shipped by UPS next day service, they can be tracked using a tracking number. If your goods are shipped by Royal Mail they cannot be tracked.

To check your order status, just sign in to your account and click My Orders.

Order Status:

  • Order Received: Your order hasn't been processed yet
  • Order Processing : Your order is currently being processed and could be at any stage between being received by the warehouse and being dispatched
  • Order Dispatched: Your order has left our warehouse. You will receive an email confirming dispatch. Depending on our chosen carrier, you may receive a separate email from us, detailing how to track your order once it has left our warehouse.
  • Order Cancelled: Your order has been cancelled, either at your request or by our team

Missing, incomplete or damaged orders

If your order has not arrived or is incomplete, please first check your order status online by signing into your account and selecting My Orders.

If your order has been despatched but hasn't arrived within the expected period, please contact our Customer Services team, or call us on 020 8965 9281 between 8.00am and 5.00pm (Monday - Thursday), 8.00am - 12:30pm (Friday).

Your purchase history

To find out more information on your past orders, please sign into Your Account, and select My Orders.

Please be aware that past orders will only be displayed if you signed in to your account when you ordered.

Items that you've returned to us will show us as Returned on the order itself.

Returns procedure

If your order hasn't arrived, or arrives incomplete, first please view your order online by signing into Your Account and selecting ‘My Orders.

Terms & conditions

If you're dissatisfied with your purchase, please let us know. Unless faulty, we'd like this to be within 90 days of purchase.

To ensure a smooth return process, any unwanted item must be in a re-saleable condition unless it is faulty. This means the item should be undamaged, unused, and retain all original packaging and labels.
